Do I need to have an attorney to get a divorce?
I want to ask if i need to have an attorney to get a divorce?

Yes it is legal in many states to obtain a divorce without representation by counsel, but it's inadvisable, because of the complex issues involved.

You do not need to hire an attorney. You could use a nolo press book or get the files online. You can even file the papers together. There are free plans on sharedparentingworks.org. Your parenting plan should be as simple as it can be, and as detailed as it need be. I suggest making it very flexible, keeping most agreements out of the courts.

If you're having trouble agreeing on child custody, as a couple you could hire a mediator.

If you'd feel better having an attorney, you can hire a collaborative divorce attorney. In the best interest of your children, you can share physical and legal custody equally.

If you want to have your own attorney, you could each hire a collaborative divorce attorney.
